Wakiso Grade one Magistrate, Esther Nyandoi, has duly declined to issue a warrant of arrest against Kyadondo East youth legislator Mr. Robert Kyagulanyi popularly known as Bobi Wine.
This plea for a warrant of arrest was filed by city lawyer, Male Hassan Mabirizi, who claimed that Mr. Sentamu had on numerous occasions snubbed court summons to answer for submitting wrong documents.
Mabirizi, in his private capacity, alleges that on 11th, July 2017 at the Parliamentary building, Mr. Kyagulanyi gave false information to Parliament regarding his date of birth. He further stated that the legislator also lied to the passport office that he was born on 12th February 1982 which was contrary to the date reflected on his academic transcripts.
The Magistrate turned down the request and willfully ordered that the case be handed over to the Office of the Director of Public Prosecutions (ODPP) much to the dismay of Mabirizi. The latter made it known that the Constitution of Uganda does not give the DPP absolute power to take on a private prosecution.
In a counter submission, Her worship Esther Nyandoi indicated that the DPP in this case did not need permission to take on private criminal prosecution.
Mabirizi, not content with the Magistrate’s ruling, went ahead to appeal the decision given and also asked for a copy of the typed proceedings.
